How We Use Your Personal Information

Depending on how you interact with us and which Services you use, we may use personal information for the following purposes:

Providing, Tailoring, and Improving the Services

We use personal information to provide the Services, perform our contract with you, process payments, fulfill orders, remember preferences, send account or order notifications, process purchases, returns, exchanges, or other transactions, manage customer accounts where available, arrange shipping, provide customer support, and improve the shopping experience.

This may include tailoring or improving the Services based on how customers interact with the store.

Marketing and Advertising

Where permitted by law and consistent with your choices, we may use personal information to send marketing or promotional communications by email or other available channels and to display advertising for products or services on the Services or other websites.

This may include advertising based on products you previously viewed, purchased, or placed in your cart, or other activity associated with the Services.

Security and Fraud Prevention

We use personal information to provide a secure payment and shopping experience; authenticate accounts where applicable; detect, investigate, or respond to potentially fraudulent, illegal, unsafe, or malicious activity; protect public safety; and secure the Services.

If you create an account, you are responsible for keeping your account credentials secure. We recommend that you do not share your username, password, or other access details with anyone else.

Communicating With You

We use personal information to provide customer support, respond to inquiries, provide effective services, and maintain our business relationship with you.

Legal Reasons

We may use personal information to comply with applicable law or valid legal process, respond to requests from law enforcement or government agencies, investigate or participate in legal proceedings, enforce our terms and policies, and investigate potential violations of those terms or policies.

How We Disclose Personal Information

In certain circumstances, we may disclose personal information to third parties for legitimate purposes consistent with this Privacy Policy. These circumstances may include:

  • With business or marketing partners that help provide marketing services or advertising, where permitted by law.
  • When you direct us, request that we do so, or otherwise consent to the disclosure of information to a third party, such as when information must be shared to ship a product.
  • With affiliates or within a corporate group, if applicable.
  • In connection with a business transaction, such as a merger, acquisition, financing, reorganization, bankruptcy, or sale of all or part of the business.
  • To comply with applicable legal obligations, respond to subpoenas, search warrants, or similar requests, enforce applicable terms or policies, and protect or defend the Services, our rights, and the rights of users or others.

Depending on where you reside, you may have the right to opt out of certain uses of personal information for targeted advertising or sharing. You may exercise those rights through Your Privacy Choices.

Relationship With Shopify

Our online store and commerce services, including product purchasing and checkout, are provided through Shopify. Portions of the Acre & Tone website are hosted and operated through other service providers.

Shopify collects and processes personal information when you interact with Shopify-powered commerce features in order to provide, secure, and improve those features. Information submitted through Shopify-powered commerce features may be transmitted to and processed by Shopify and other service providers, including providers located in countries other than the country in which you reside.

We may use Shopify features that use information from your interactions with our store, Shopify, and other merchants to provide enhanced services, security, analytics, personalization, or advertising. Where Shopify determines the purposes and means of this processing, Shopify is responsible for responding to requests relating to that processing.

To learn more about how Shopify collects, uses, and shares personal information, please review the Shopify Consumer Privacy Policy.

Depending on where you live, you may also be able to manage certain Shopify privacy choices through the Shopify Privacy Portal. Shopify provides privacy controls through its public privacy portal.

Third-Party Websites and Links

The Services may contain links to websites or other online platforms operated by third parties.

If you follow a link to a site that is not affiliated with or controlled by us, you should review that site’s privacy and security policies and other terms and conditions. We do not guarantee and are not responsible for the privacy, security, accuracy, completeness, or reliability of third-party sites.

Information you provide in public or semi-public areas, including information shared through third-party social-networking platforms, may be viewable by other users of those platforms or Services.

Our inclusion of a third-party link does not, by itself, imply endorsement of the content, owners, or operators of that platform.

Children’s Data

The Services are not intended for use by children, and we do not knowingly collect personal information from children under the age of majority in their jurisdiction.

If you are the parent or guardian of a child who has provided us with personal information, you may contact us using the information below to request that the information be deleted.

As of the date this Privacy Policy was last updated, we do not have actual knowledge that we “share” or “sell,” as those terms are defined by applicable law, personal information belonging to individuals under 16 years of age.

Security and Retention of Your Information

No security measures are perfect or impenetrable, and we cannot guarantee absolute security.

Information you send to us may not be secure while in transit. We recommend that you do not use unsecured channels to communicate sensitive or confidential information.

How long we retain personal information depends on several factors, including whether the information is needed to maintain an account, provide the Services, fulfill orders, comply with legal obligations, resolve disputes, prevent fraud, or enforce contracts and policies.

Your Rights and Choices

Depending on where you live, you may have some or all of the rights listed below regarding your personal information. These rights are not absolute, may apply only in certain circumstances, and may be subject to exceptions permitted by law.

Right to Access or Know

You may have the right to request access to personal information we hold about you.

You may exercise these rights through Your Privacy Choices.

If you visit the website with a recognized Global Privacy Control preference signal enabled, we may treat that signal as an opt-out request for the device and browser used to access the website, where required by applicable law.

If the device can be associated with a Shopify account, Shopify may also apply the opt-out request to that account.

To learn more about Global Privacy Control, please review Global Privacy Control.
